This is a translation provided for convenience. The Swedish version is legally binding.

1. Introduction and acceptance

These general terms and conditions (the "Terms") constitute a legally binding agreement between you as a user (the "User", "you", "your") and Mitt Stall (the "Company", "we", "us", "our") regarding your use of the Mitt Stall service, which is provided through the website mittstall.se and the Mitt Stall app for iOS and Android (the "Service").

By creating an account, signing in to or otherwise using the Service, you confirm that you have read and understood these Terms and our privacy policy and agree to be bound by them. If you do not accept the Terms in their entirety, you are not permitted to use the Service and must immediately stop all use of it.

We reserve the right to change, add to or remove parts of these Terms. How we give notice of changes is described in section 11.

2. Description of the Service

Mitt Stall is a digital service for keeping horses: horse profiles with health and activity information, forage analyses by manual entry or by uploading PDF documents, feeding and feeding plans based on nutritional calculations or artificial intelligence, chores, a calendar, a training log, collaboration in stables with invites and per-horse permissions, and contacts for vets, farriers and others.

The Service is offered in different versions with varying functionality and pricing, as stated on the website. We reserve the right to change, update, limit or discontinue parts of or the entire Service. We will give reasonable notice of material changes.

3. Age requirements and registration

To use the Service, you must be at least thirteen (13) years old. If you are between thirteen (13) and eighteen (18) years old, you must have your parent or guardian's consent before you register for or use the Service. By using the Service, you confirm that you meet the age requirement and, where applicable, that you have that consent.

When you register, you undertake to provide truthful, accurate and current information about yourself and to keep it up to date. If you provide information that is untrue, inaccurate or incomplete, or if we have reasonable grounds to suspect that this is the case, we are entitled to suspend or terminate your account.

You are responsible for keeping your login credentials secret and for all activity that takes place under your account. Notify us immediately if you suspect unauthorized use of your account. We are not liable for losses arising from unauthorized use of your account, but you may be held liable for losses suffered by us or others as a result of such use.

4. AI-generated content and disclaimer

IMPORTANT: THIS SECTION CONTAINS SIGNIFICANT LIMITATIONS OF THE COMPANY'S LIABILITY THAT YOU SHOULD READ CAREFULLY.

The Service may provide feed recommendations, feeding plans and suggestions from the feeding advisor using artificial intelligence ("AI-generated content"). You expressly acknowledge and agree that all AI-generated content is provided for informational purposes and as general suggestions. Under no circumstances does it constitute veterinary advice, professional nutritional advice or a substitute for consultation with a veterinarian, equine nutritionist or other qualified professional.

You understand and accept that AI systems have inherent limitations and may give inaccurate, misleading or inappropriate recommendations. Every horse is an individual whose nutritional needs are affected by age, breed, health, workload, climate and other factors that an automated system cannot always capture or assess correctly.

You assume full responsibility for: (a) critically reviewing all AI-generated content before applying it; (b) assessing whether a recommendation is appropriate and safe for your horse, taking its individual circumstances into account; (c) always consulting a veterinarian or qualified equine nutritionist before changing your horse's feed ration, especially if the horse has health problems, is in foal, is a young or senior horse, or has other special needs; (d) monitoring the horse's health, weight, body condition and general condition when new feeding routines are introduced; and (e) immediately seeking veterinary care if the horse shows signs of illness, colic, laminitis or other symptoms.

MITT STALL, ITS OWNERS, BOARD MEMBERS, EMPLOYEES, AGENTS, LICENSORS AND PARTNERS HEREBY EXPRESSLY DISCLAIM ALL LIABILITY FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO INJURY TO OR LOSS OF HORSES OR OTHER PROPERTY, VETERINARY COSTS, DEATH, ILLNESS, COLIC, LAMINITIS, NUTRITIONAL DEFICIENCIES, WEIGHT CHANGES OR ANY OTHER DAMAGE THAT MAY ARISE DIRECTLY OR INDIRECTLY FROM THE USE OF OR RELIANCE ON AI-GENERATED CONTENT OR ANY OTHER PART OF THE SERVICE.

By using the Service's AI features, you confirm that you have read, understood and accept this disclaimer and that all use is at your own risk.

5. User obligations and prohibited use

You may only use the Service for lawful purposes and in accordance with applicable laws and regulations. You agree not to: (a) use the Service in a way that could damage, disable, overload or impair our servers or networks; (b) attempt to gain unauthorized access to any part of the Service, other accounts or systems connected to the Service; (c) use automated tools to collect or copy information from the Service; (d) distribute malicious code; (e) interfere with the operation of the Service; (f) circumvent security measures; (g) impersonate anyone else; (h) use the Service for commercial purposes beyond its intended use without our written consent; or (i) help anyone else do any of the above.

You are responsible for making sure that the information you enter about your horses and your feed is accurate to the best of your knowledge. If you invite others to your stable, you are responsible for making sure that they are entitled to see what is shared there and that they are aware of these Terms.

6. User content and intellectual property rights

You retain all rights to the content you create or upload in the Service ("User Content"): horse profiles, forage analyses, feeding plans, photos, notes and other data. By entering User Content, you grant us a non-exclusive, royalty-free license to store, process, display and transmit it solely to provide, maintain and improve the Service for you and the people you share your stable with.

The Service and all of its content, including software, text, graphics, logos, icons, design and source code, are owned by Mitt Stall or its licensors and are protected by Swedish and international copyright, trademark and other intellectual property laws.

You may not copy, distribute, modify, create derivative works of, publicly display or otherwise use material from the Service beyond your own User Content and what the Terms expressly permit. You may not decompile or otherwise attempt to extract the Service's source code.

7. Payment, subscriptions and pricing

The Service is offered in different versions according to the pricing stated on the website at any given time. Subscriptions are purchased and managed on mittstall.se. A subscription may begin with a trial period, the length of which is stated on the website; nothing is charged during the trial period.

The following applies to paid subscriptions: the fee is charged in advance for each billing period; the subscription renews automatically at the end of the period unless it has been canceled; and you are responsible for keeping your payment details up to date and for the fees incurred under your account.

You can cancel your subscription at any time under Subscription in the settings on mittstall.se or by contacting us. Cancellation takes effect at the end of the current billing period, and you keep access to the Service until then. No refund is given for the remaining time in a billing period that has already begun.

We reserve the right to change our prices. We will give notice of price changes at least thirty (30) days in advance by email to the account's address or through a notice in the Service. If you do not accept the new price, you can cancel your subscription before the change takes effect.

8. Limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY APPLICABLE LAW, MITT STALL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure or error-free, that results obtained through the Service will be accurate or reliable, or that errors in the Service will be corrected.

IN NO EVENT SHALL MITT STALL, ITS OWNERS, BOARD MEMBERS, EMPLOYEES, AGENTS, LICENSORS OR PARTNERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY OR ANY OTHER DAMAGE ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) CHANGES TO OR DISCONTINUATION OF THE SERVICE OR ANY PART OF IT; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (D) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (E) ANY OTHER MATTER RELATING TO THE SERVICE.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, MITT STALL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE LEGAL BASIS, IS LIMITED TO THE AMOUNT YOU HAVE ACTUALLY PAID US FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT THAT GAVE RISE TO THE CLAIM.

Nothing in these Terms limits the rights you have as a consumer under mandatory law.

9. Indemnification

You agree to indemnify and hold harmless Mitt Stall and its owners, licensors, service providers, board members, employees and agents from and against all claims, losses, costs and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your breach of the Terms; (c) your violation of any third party's rights; or (d) your User Content.

10. Account termination

You can delete your account yourself at any time: in the app under My profile, on mittstall.se under your profile, or by emailing support@mittstall.se from the account's email address. What is deleted and what stays with the stable is described in our privacy policy. A stable that you are the sole owner of is deleted along with the account, and an active subscription is canceled. If a stable you own has other members, you first need to remove them or make someone else the owner.

We reserve the right to suspend, restrict or terminate your account if we reasonably determine that: (a) you have breached the Terms or applicable law; (b) you have engaged in fraudulent or illegal activity; (c) you have misused the Service or subjected it to abnormal load; (d) it is necessary to protect the security of the Service; or (e) there are other reasonable grounds. Where possible, we will notify you in advance.

When your account is terminated, all rights granted to you under the Terms end. Provisions that by their nature should survive termination, such as ownership, warranty disclaimers, limitations of liability and indemnification, continue to apply.

11. Changes to the Terms

We may revise these Terms. We will give notice of material changes that affect your rights or obligations at least fourteen (14) days before they take effect, by email to the account's address or through a clear notice in the Service. The date at the top of the page shows when the text was last changed.

If you continue to use the Service after the changes have taken effect, you accept them. If you do not accept them, you must stop using the Service and close your account.

12. Governing law and dispute resolution

These Terms and all disputes arising out of or in connection with them are governed by Swedish law.

Disputes shall first be resolved through negotiation in good faith. If a dispute cannot be resolved within thirty (30) days, it shall be decided by the Swedish general courts, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance, unless mandatory consumer legislation entitles you to another forum.

As a consumer resident in the EU, you can turn to alternative dispute resolution. In Sweden, this is the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, www.arn.se. You can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

13. Miscellaneous

These Terms, together with our privacy policy, constitute the entire agreement between you and Mitt Stall regarding the use of the Service and supersede all prior agreements.

If any provision of the Terms is found to be invalid or unenforceable, it shall be interpreted so that its purpose is achieved to the extent permitted by law, and the remaining provisions continue to apply.

If we do not enforce a right, that does not mean we waive it. A waiver is valid only if made in writing by an authorized representative of Mitt Stall.

You may not assign these Terms without our written consent. We may assign the Terms in connection with a transfer of the Service, and will notify you if we do.
